MINUTES OF THE PUBLIC MEETING OF AUGUST 24TH    , 2004
HANSON TOWN HALL, LIBERTY ST., HANSON, MA

Called to Order:  7:30 PM under the M.G.L. Chapter 131, s.40 and the Hanson By-Law 1-13, s.5.  by Philip R. Lindquist, Chairman, in the Conservation Office on the second floor of Town Hall.

Public Hearings

7:45 PM  Continued Notice of Intent for the proposal of an addition and parking with associated grading at 2 Main Street, Assessor’s Map 38, Lot 5 for V.S.H. Realty/Cumberland Farms, 777 Dedham St., Canton, MA  02021 represented by Land Planning, Inc., 1115 Main St., Hanson, MA     (DEP #175-438)

This hearing had been continued from July 27, 2004.  Mr. Bernard Munro of Land Planning, Inc. presented a revised plan showing the gas trap detail and another catch basin off Main Street at the edge of the pavement.  The haybale line is shown right along the 50-foot no disturb zone.  Also, a roof drain had been added.  Ms. Delaney would like the Stormwater Management plan to specify who will be cleaning the catch basins and the infiltration system.  Also, she would like the wording to be changed from “should be” to “shall be” maintained.  A Mr. Richard Boyle representing Cumberland Farms discussed with the Board the drainage plan and infiltration system.  Mr. Lindquist wants a revised plan to clarify the detail of the system and the correct labeling for it.

8:15 PM  Notice of Intent for construction of 615 linear feet of new roadway and infrastructure, including two detention ponds at a)1443 Main St., Map 44/Lot 10 and b) Elm Street, Map 36/Lot
8-2 for applicant Donald Shute, Chilmark Co., 345 Washington St., Pembroke MA represented by GCG Assoc., Inc., 226 Lowell St., Wilmington, MA  01887  (DEP #175-0441)  (New Hearing)

Craig Nicholson read the Public Hearing Notice and the green cards were checked.  A Mr. Jeremy Downs of GCG Associates made the proposal for a new roadway (Progress Way) off of an already approved subdivision (Brookside Estates).  Five new lots have been created, some of which will require individual filings.  Haybales and silt fence are proposed at the limit of work.  Ms. Delaney had made a site visit and written a draft letter itemizing a list of concerns.  She would like a written response to all of her comments.  Also, Mr. Downs was informed that the Board would require a consulting fee for the wetland delineation confirmation.    Mr. Lindquist read off the abutter’s list.  The son of deceased abutter Thomas Brine of Elm Street, Preston Brine, asked if the subdivision would be using town water.  Mr. Downs answered no, individual wells would be dug.   However, town water would be used for fire hydrants.  Mr. Brine also wanted to know who delineated the wetland line.  The botanist report from Mr. John P. Richardson was read by Phil Lindquist.  Ms. Delaney will finalize her letter and check the wetland line.

8:30 PM  Notice of Intent for the proposed repair of the subsurface sewage disposal system, including the installation of a septic tank, pump chamber, sewer force main, soil absorption system, grading & landscaping at 204 Phillips Street, Assessor's Map 50, Lot 104 for applicant Richard Roderick 127 Mountainview Dr., Wells River, VT represented by Land Planning, Inc., 1115 Main St., Hanson, MA. Craig Nicholson read the Public Hearing Notice and the green cards were checked.  Bernard Munro made the presentation for a septic repair.  The new system is going in the front yard.  It has been Board of Health approved, however they are awaiting a sieve analysis from the State.  A rubber barrier will be installed all around the system to prevent breakout.  Mr. Lindquist read the abutter’s list.  None were present.

9:00 PM  Continued Notice of Intent for repair of an existing septic system partially located within the 100-foot buffer zone and 200-foot outer riparian zone and replacement of formerly existing kitchen, bathroom & porch previously destroyed by fire at  903 West Washington St., Map 67, Lot 9A for owner Richard Maurano represented by Outback Engineering, 165 East Grove St., Middleboro, MA  02346.  (DEP #175-435)

This hearing had been continued from July 13, 2004.  Leanne Bradley of Outback Engineering reported that the septic had been Board of Health approved.  Also, Ms. Delaney had made a site visit and determined that the wetland delineation was accurate.  The only change to the plan was to take down a dead pear tree, a diseased hemlock tree and two, very old apple trees.  The apple trees will be replaced with new ones.  Mr. Grattan would like to see all the debris, i.e. cars, junk, tires, etc. taken out of the riparian zone.

Craig Nicholson read the Public Hearing Notice and the green cards were checked.  Bernard Munro made the presentation.  The Board of Health is requiring a couple of changes to the plan.

Dennis Leary and representatives, John Keefe and John Burnes of Keefe Associates attended the hearing as well as Brook Munro who did the delineation.   A revised plan was submitted showing the existing conditions at the site.  Janine Delaney and Craig Nicholson had made a site inspection and used an auger to determine the soils on the roadway.  They went down about two

feet.  No hydric soils were observed.  It was the opinion of the agent that the roadway was pre-existing and the wetland area was created by bringing in fill.  However, she would like a determination to be made as to how much buffer zone was altered as there is a disturbance fee for such activity.  Mr. Lindquist voiced concern over the neighbor’s yard flooding and drainage from rainwater across the road.  He would like to see a revised plan with water going under the road.  At this point, the Commission agrees with the wetland delineation only.

Appointments

Dean Anderson of 62 Ocean Avenue at the request of the agent came before the Board to explain what he was doing at his property.  He was observed clearing trees and working with a backhoe.  He stated that he has started work on his septic.  He has also installed some haybales.  John Delano was doing the plan.  The Board told him to continue and to file an After-the fact Notice of Intent.

inspection whether or not particular erosion controls are needed.  However, Goscon will pay for the extra inspections that were incurred.

Inspection of 999 Main Street, owner Ed O’Donnell – Ms. Delaney had made a site visit and talked with the owner.  She advised him to do no more exterior work and to come in and speak with the Commission.  He is working on a site plan.
